Gaia save me from my muses. XD Still working on that Iron Man fic, but Hern demanded some attention (writing being Maer's balliwick), so I took a break from the fic this weekend to do an Iron Man-related craft: a light-up Arc reactor:

You may remember me mentioning last week that I was waiting (impatiently) for the Robert Downey Jr CD I had ordered -- well, the gods were kind, and I got it early! My review: [link]

So people are still talking about the proposed Orphan Works bill, and it's looking more and more like it may be real (though I am still seeing articles that claim it is a hoax as well). And I can see why people are upset, BUT ...

Like I've said before, you *already* HAVE to register your work at the copyright office *if* you wish your work to be protected. The fact that your copyright exists the moment you create a work *currently* means *nothing* in a court of law. It's an illusion, people.

From the US Copyright
office: "You will have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work." They're talking about the law as it exists at this very moment.

From them regarding mailing works to one's self as copyright protection: "The practice of sending a copy of your own work to yourself is sometimes called a ' poor man’s copyright '. There is no provision in the copyright law regarding any such type of protection, and it is not a substitute for registration."

Well, what the hell is copyright good for if not for allowing you to sue someone for infringing on your work? According to them, you CAN'T sue, unless you register -- and the current registration fee is $35 online, $45 for hard-copy. But under the Orphaned Works Act, if the things I've read are true, that fee will drop to only a $1. I repeat -- you are *not* protected under *current* copyright law unless you register the work *anyway* -- so wouldn't you rather pay a lot less to register? Remember, people can *already* steal your work and use it unless you catch them doing it and can prove that you are the originator! It may be wrong, but there's already nothing we can do about it other than take them to court! And if you try to take them to court without your work being registered, you will be no better off than you would be with how this bill proposes things be done. Don't kid yourself into thinking you'd have a better chance of winning at the moment.

Truthfully, the need for the law at all sucks, and, as it's currently written, it's poorly conceived, but really, how else could you prove a work is yours if not through official legal documentation? Registering really is the only way. I'd have registered a lot of my stuff a long time ago, if not for it being cost-prohibitive -- now I can forsee periodically sending my stuff in, getting protection on 35 works at once for the same price it currently takes to register one peice. Obviously, if current law didn't require you to register to actually protect your work in court, I'd be against the oprhaned works bill for serving art-theives -- no way do I think anyone should take art that isn't theres and use it commercially -- but since the current law *doesn't* protect you otherwise ... I'd say the proposal so far sounds like it's actually *better* deal for the artist.

Register your work, and you'll have nothing to fear, no matter whether the bill passes or not.

------------------------------------------

In other news ... when, feeling curious, I googled Robert Downey Jr, aka Tony Stark/Iron Man (I was already a fan of his work, I just wanted to know more about him -- I google people all the time to see what they've done that I may have missed), I discovered that he put out a muscial album in 2004. The website for him has snippets of the songs -- *really* good stuff! [link] Alas, they don't sell downloads of all the songs online, and stores don't carry it, so I broke down and ordered the CD last Friday. It won't get here until the 27th, though, and I'm finding myself feeling very impatient! XD
